A Tuscaloosa County judge is considering a request by the attorney for a former Brookwood High School teacher to declare unconstitutional the state's law that prohibits a school employee from having sex with a student under age 19.Joe Bradley Petrey, 28, of Northport, was charged in August under the school employee sex law for having sex with an 18-year-old female student.A woman who said her former teacher at Brookwood High School sexually abused and harassed her while she was a student has filed a federal lawsuit against him and school officials who she claims did not stop the abuse. W., filed the civil lawsuit in the Northern District of Alabama last month. W's Title IX rights were violated because school leaders did not act in stopping the abuse she faced from former teacher and coach Joe Bradley Petrey. The two also took pictures together, including photos in bed, and Petrey saved them into a public folder online. Vice Principal Burroughs told the teachers that Petrey was being investigated by the school board, and the matter would be handled. That investigation centered on several illicit photos online. said the relationship didn't turn sexual until after she turned 18. W.'s attorney, said the civil suit was the only way to make the school system accountable. wrote a letter to the District Attorney asking that the criminal case be re-instated.In addition to Petrey, the lawsuit names the Tuscaloosa County School System, former Superintendent Elizabeth Swinford, seven school board members, former Principal Laura Mc Bride, Vice Principal Thad Fitzpatrick, and former Vice Principal Marcy Burroughs as defendants. Records show the relationship continued into the 2014-2015 school year, and lasted for another year and a half while A. The next school year though, the dance teachers were still hearing rumors about A. A criminal case against Petrey filed in 2015 under the school employee sex law for having sex with an 18-year-old student, was dismissed by a Tuscaloosa County judge earlier this year after A. told prosecutors "that she has no intentions of cooperating with the prosecution of this case," records show. "The goal of the lawsuit is to put something in place to prevent something like that from happening again," she said.
